Terms of service

The agreement
By signing up for Mailstinger ("the Service") you agree to these Terms. The Service is provided by Mike, sole proprietor, DBA Mailstinger ("we", "us"). Mailstinger LLC formation is in progress; this agreement assigns to the LLC on formation without renegotiation, and we'll notify customers when that transition closes.
What you can do
- Add domains you own, or domains you manage on behalf of clients with their authorisation.
- Resell the Service to your own clients under your MSP brand (white-label is included on plans that list it).
- Export your data at any time via the API or by emailing support.
- Cancel any time via the customer portal — no refunds on pre-paid time, but no further charges.
What you can't do
- Add domains you don't own and don't have written authorisation to manage.
- Use the Service to send unsolicited bulk email (you do you, just not from infrastructure that touches us).
- Probe the Service's infrastructure for vulnerabilities without written permission. Responsible disclosure is welcomed at support@mailstinger.com.
- Resell the Service in a way that misrepresents Mailstinger as your own backend product (white-label is fine; "we built this from scratch" is not).
Billing
Subscriptions auto-renew until cancelled. Card processing is handled by Stripe; Mailstinger does not store card data. Annual subscriptions are non-refundable except where required by law. Failed payments: we retry on the standard Stripe schedule and email warnings; service access continues uninterrupted for 7 days after a failed payment.
Service level
We aim for 99.9% uptime measured monthly, excluding scheduled maintenance windows announced on status.mailstinger.com. Breaches eligible for service credit under SLA-bearing plans (Agency, Enterprise) — file via support email; credits appear on the next invoice.
Liability cap
Our liability for any claim arising under these Terms is capped at the amount you paid us in the 12 months preceding the claim. We aren't liable for indirect or consequential losses (lost profits, lost business, lost data not covered by our backup schedule).
Termination
You may cancel any time. We may suspend an account with 7 days' notice for material breach (sending unsolicited bulk email from our infrastructure, repeated payment failures, abuse of other tenants' data). On termination, you have 60 days to export your data via the API; after that we purge it.
Governing law
Delaware (USA), with disputes heard in courts of New Castle County. Class actions waived. Either party may initiate small-claims actions.
Changes
We'll email you at least 14 days before any material change to these Terms. Continued use after the effective date is acceptance.
